Comstor Elevate Terms and Conditions

 

Comstor Elevate is the overarching rewards and loyalty program for Comstor partners selling Cisco solutions.

Within Comstor Elevate are a number of other specific rewards programs and incentives. These have their own terms and conditions and will vary periodically. The current programs available within Comstor Elevate are listed below with full terms.

Comstor will provide the Award to a Participant who meets the Program Requirements and has made a Claim for the Award. The Program Requirements are as follows: Eligible Partners are required to register their inclusion in the program at the Comstor Elevate Website.

To have a valid claim for the Award, the Participant must be in good standing with Comstor at the time of the claim, must not be in breach of these Terms or any other agreement that they have in place with Comstor and must demonstrate to Comstor’s satisfaction that they have fully and completely met the Program Requirements ("Claim"). For a Participant’s Claim to be valid, it must also be made in accordance with these Terms and all terms contained in the Program materials and, where applicable, the relevant Partner

  • Unless a different governing law is stated to apply in the specific terms of a Program, the terms and conditions of the Program are governed by the laws in Australia as applicable.
  • No exceptions to the Program will be allowed. Comstor has the right to deny all claims that do not meet the criteria and requirements outlined in the Program.
  • Comstor reserves the right to modify, extend or discontinue the Program, in whole or in part, at any time and without further notice. Without limiting the generality of the previous sentence, the eligible Comstor products and/or services included in the Program may be changed or substituted at any time.
  • The Program may not be combined with any other Comstor offer, incentive or promotion, unless otherwise stated in the Terms.
  • All sales are calculated in AUD.
  • Comstor has the right in its absolute discretion to deny any claim to entitlement under the Program and/or may prohibit a Participant from participating in the Program where Comstor (in its absolute discretion) determines that such Participant is attempting to undermine the legitimate operation of the Program by cheating, hacking, deception or other unfair playing.
  • All decisions by Comstor are final.
  • The Program is void to the extent prohibited or otherwise restricted by applicable local law. If a portion of the Program is found to be prohibited or otherwise restricted by applicable local law, only that portion of the Program will be void.
  • Comstor, and all their respective officers, directors, employees, representatives, and agents will have no liability to, and will be held harmless by a Participant making a Claim under the Program, for any loss, damage or liability directly or indirectly related to the acceptance, possession, delivery, use or misuse of any matter or thing awarded under the Program.
  • Any disputes, legal claims and causes of action arising out of or in connection with the Program will be resolved individually, without any resort to any form of class action.
  • Comstor is not responsible for any lost, late, or misdirected mail (including email) nor for any errors, omissions, interruptions, defects, or delays in any technical platforms or means of electronic transmission used in the publication or Participation of the Program.
  • If Comstor collects any personal data of a Participant because of their participation in this Program, Comstor will deal with that data in accordance with its Privacy Policy.
  • Comstor will have no liability to any Participant or other person under the Program or otherwise for lost profits, loss of use, lost or corrupted data, loss of goodwill or for any incidental, indirect, special, or consequential losses or damages arising in connection with or under the Program and/or the Program terms and conditions, even if Comstor has been notified of such losses or damages.
  • Any FBT liability is the responsibility of the Individual Staff Representative. Consequently, it is solely the Individual Staff Representative's responsibility to report and pay all applicable taxes or duties that may be required under any appropriate laws related to the Incentive(s) he/she receives. The Individual Staff Representative may consult his/her own tax advisor with any question or concern about the taxes that apply to him/her in relation to this Staff Incentive Program.

By clicking “I Agree” upon registration, Partner is indicating that a representative of the Partner with the authority to bind the Partner contractually has read and agreed to the terms and conditions of this Agreement and The Program.

Comstor Xchange Program

  • Eligible Partners: Approved Comstor Partners
  • Program Registration: Participating reseller sales representatives must register into the Comstor Elevate Portal in order to access Comstor Xchange rewards.
  • Reward Process: To earn a reward you must claim via through the Comstor Xchange portal access via the Comstor Elevate Portal. Awarded rewards can then be redeemed for a Virtual MasterCard.
  • Points Expiry: All claims will expire after 14 days and will not be available to claim after this time.

By participating in this incentive scheme you confirm that you have ensured that such participation is in compliance with your organisation's own internal policies and procedures regarding incentives, anti-bribery, gifts, favours and entertainment and that you will bring the incentive to the attention of your organisation and obtain any necessary approvals before receiving the incentive.
1.Participation in the “Hop on Over, Bunny!” promotion (“Promotion”) is conditional on your acceptance of:
a.
These rules;
b.
The interpretation of the rules being at Comstor’s discretion; and
c.
Any decision by Comstor in respect of the Prize / Promotion, interpretation of the Rules being final.
2.The Promotion is a Comstor & Cisco Incentive where eligible partners including T2 Registered, Select, Premier & T2 Gold partners get rewarded for orders using Deal ID, Fast Track pricing on Cisco Meraki Software/SAAS/Reoccurring orders invoiced in the promotional period. Total prize pool value is up to AUD$100,000.
3.The promoter is Westcon Group Pty Limited Pty Ltd (ABN 77 050 539 672) of 4/39 Herbert Street, Sydney NSW 2065, telephone (02) 9432 1000 (“Promoter”).
4.Staff members of the Promoter, their immediate families and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5.The Promotion commences at 12:00 AM AEST on 13th Februray 2024 and is based on eligible orders invoiced between 1st February 2024 and 30th April 2024 (“Promotional Period”).

6.Entry is only open to employees of approved Cisco Partner Companies in Australia. Entrants must be registered to Comstor Elevate and have accepted the terms & conditions. Eligible partners must have a valid Comstor Partner account in good standing to earn and receive rewards in the Program.
7.Entrants must be aged 18 years or older to enter and consent to these Terms and Conditions.
8.Rewards will be allocated on a per company basis. The registered contact may not always be the recipient of the final reward. Once prize/s have been delivered, each Partner Company has the responsibility to manage any internal allocations.
9.Eligible partner companies include T2 Registered, Select, Premier & T2 Gold partners for orders using Deal ID, Fast Track pricing on Cisco Meraki Software/SAAS/Reoccurring orders invoiced in the promotional period with Comstor.
10.T1, Gold & Global Gold partners (regardless of partner registration level) are not eligible to participate in this program.

Eligibility is deemed as per Comstor internal reporting. This may differ from what is visible to both Partner Companies & Cisco. Although Comstor may at their sole discretion provide supplementary reporting, this is not required, and no further discussion will be entered into.

14.The Prize will be rewarded to the Eligible Person who successfully meets the eligibility criteria as set out in clauses 2, 6, 7, 8, 9, 10 and 11.
15.As there is a limited prize pool available, incentives are issued on a “first In, first served” basis. Prizes or rewards will be issued via Xchange in the form of Virtual Prepaid MasterCard rewards. Rewards must be claimed within 14 days of upload on to the Xchange sales claim page after which date they will lapse.
16.Total rewards capped at $7,500 AUD per qualifying partner company, and $3,000 AUD per individual.
17.By accepting the terms and conditions of the promotion, the recipient accepts that any income tax payable on the Virtual Prepaid MasterCard reward is the sole responsibility of the recipient and not Comstor or Cisco. The recipient’s employing partner acknowledges that any Fringe Benefits Tax payable the Virtual Prepaid MasterCard reward is the sole responsibility of the partner and not Comstor or Cisco.
18.Virtual Prepaid MasterCard rewards are awarded based on final value of purchase order invoiced net of any related Credits or Returns
19.The Promoter makes no warranty as to the availability of the Prize. If the whole or part of the Prize is unavailable, then the Promotor may at its discretion provide a substitute prize of equal or greater value to the Prize.
20.All prizes will be made available on an “as is” basis. The Promoter makes no warranty as to the quality, adequacy, fitness (for any purpose) or suitability of any prize.
General
21.Comstor reserves the right to exclude price-supported business.
22.Registration is on behalf of the participating individual.
23.Only recipients who provide end user data (where required) shall be entitled to the Prize.
24.Comstor reserves the right to withdraw the Prize should your organisation’s Comstor account be in arrears.
25.Comstor is not responsible for any tax liabilities associated with the provision of the Prize including but not limited to those incurred by the individual recipient and your organisation. *
26.The Promoter reserves the right at any time to verify the entries of Eligible Persons and in its sole discretion, to disqualify any Eligible Person the Promoter has reason to believe has breached these terms, tampered with the entry process, or engaged in any unlawful or unethical conduct in relation to their participation in the Promotion.
27.Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
28.The Promoter’s decision is final, and no correspondence will be entered into.
29.If for any reason a winning Eligible Person does not take a prize by the time stipulated by the Promoter (which shall be no less than one (1) month from the time of the announcement), then the prize will be forfeited and may be given to another recipient at Promoter’s discretion.

33.Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (howsoever arising, including but not limited to negligence), for any personal injury or any loss or damage (including loss of opportunity and profit) whether direct, indirect, special or consequential, arising in any way out of or in connection with but not limited to:
a.
any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
b.
theft, unauthorised access or third party interference;
c.
any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
d.
any failure of the Promoter to do anything because of an event beyond its reasonable control, including an act of God, epidemic (including COVID-19) or government order;
e.
any variation in prize value to that stated in these Terms and Conditions;
f.
any tax liability incurred by a winner or Eligible Person, or any use of the Prize.
34.The Promoter collects personal information ("PI") in order to conduct the Promotion and associated events (including webinars and physical events) and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.westconcomstor.com/global/en/legal/privacy-policy.html. The Privacy Policy contains information on how individuals may opt out, access, update or correct their PI and how they may complain about a breach of the Australian Privacy Principles, or any other applicable law. The Promoter may disclose PI to companies located outside Australia (see the Promoter’s Privacy Policy for details).

 

Comstor Xchange Participation

  • Comstor Xchange Rewards Program ("Program") is only available to reseller representatives aged 18 and above who reside in Australia. Partner representatives may not participate in the Program if doing so would violate any of their employer's policies. By participating in this Program, you confirm that you have obtained your employers' prior consent and approval to do so and that it does not violate any of your employer's policies.
  • You must be enrolled in the Comstor Elevate Portal and have a valid Comstor Partner account in good standing to earn and receive rewards in the Program.
  • Participation in the Comstor Xchange reward program is at the individual level. Corporations and other entities may not enrol in the Program. Membership in the Program is non-transferable.


Enrolment

  • Partner representatives must be first registered into the Comstor Elevate Portal. Once registration in is complete, individuals can access Comstor Elevate portal. The Comstor Elevate portal will allow individuals to access the Comstor Xchange page to claim sales rewards for eligible activities, view rewards account balance and redeem Virtual Prepaid MasterCardrewards at any time.


Eligible Activities

  • Partner representatives can earn based on completing and claiming any of the eligible activities from the current promotions.
  • Virtual Prepaid MasterCardrewards earned will be calculated as per the Reward Earnings table by country of origin of the participant's organisation.

Mobile Pay

Mobile prepaid Mastercards are valid for 36 months from the date of issue. To access you must download The Card Network App, card cannot be printed as a voucher for use. To be able to redeem virtual Mastercard rewards you must maintain enough reward $ to meet the minimum reward denomination of $20. If at redemption, program period close or account closure your rewards does not meet the minimum redemption of $20, all current monies ($) will be forfeited.
Not redeemable for cash and cannot be exchanged. Any unused value after the expiry date of any Digital Mastercard will not be refunded or credited. At the time of purchase, you should know your account balance. You may obtain your current balance 24 hours a day, 7 days a week by logging into your account on The Card Network app. If you attempt to make a purchase that exceeds your balance, the transaction will be denied. Cardholders are responsible for all purchases made with their Virtual Card.
Currently only compatible with Australian mobile numbers. Compatible with Apple Pay, Google Pay, and Samsung Pay.
Valid instore or online where prepaid Mastercard is accepted. For online use the total transaction value cannot exceed the available Digital Mastercard balance unless the merchant site has the capability to support split transactions. For full terms and conditions, please view them here.

 

Using your Mobile Prepaid Digital Mastercard:

If the card is issued via email, the activation process is as follows:

Upon placing the order customer will receive an email to confirm their details.

Upon confirmation, an SMS will be sent to the mobile number entered with a link to their Digital Mastercard.

They will need to click on the link in the SMS and follow the instructions to download The Card Network app and add the card to their mobile wallet.

Reward(s) Error Policy

This Reward(s) error policy (the “Reward Error Policy”) applies to each Participant in Comstor Elevate Accidental typographical errors sometimes occur in Reward(s) descriptions or values.  In this event, Comstor reserves the right to notify you of the correct description or value before Reward(s) is shipped.  The Reward(s) Error Policy requires prompt mitigation and recovery of all Reward(s)s issued in error for any reason; including, but not limited to data inaccuracy, inaccurate Reward Points’ valuation, processing error or miscommunication. The Reward(s) Error Policy requires immediate steps be taken to mitigate loss by reversing Reward Points deposited to Participant accounts in error, placing a hold on delivery and fulfillment of Reward(s), and/or cancelling Reward(s) orders. As a result of error mitigation steps, a Participant may have a negative Reward Points account balance. A Participant can restore his or her Reward Points’ account to a positive balance by receiving further Reward Points; or, participants may elect to be credited Reward Points by returning Reward(s) previously received by the Participant.
